1. Introduction

Welcome to Shejar, a mobile application designed to help people give away and receive items within their local vicinity for free. By accessing or using the Shejar app, you agree to be legally bound by these Terms of Service (“Terms”). These Terms govern your access to and use of the Shejar platform (the “App”), and constitute a legal agreement between you (“User”, “you”) and the creators of Shejar (“Company”, “we”, “us”, or “our”). If you do not agree to these Terms, you must refrain from using the app.

2. Nature of the Service

Shejar is a community-driven, location-based mobile application that allows users to upload images and details of used, unused or unwanted items they wish to give away. Other users can browse these items based on geographic proximity (e.g., within a 100-meter radius), and express interest in receiving them. If a giver accepts the request from a seeker, both users will receive each other’s contact details to facilitate offline communication and exchange.

Shejar does not charge for these services and does not function as a marketplace or commercial intermediary.

3. User Roles and Interactions

Users on Shejar generally play one of two roles:

  • A Giver, who uploads and lists an item they wish to give away for free.
  • A Seeker, who browses items nearby and expresses interest in receiving them.

Upon mutual acceptance, the giver and seeker are given access to each other’s basic contact information to coordinate the exchange. Shejar does not provide any in-app chat system and is not responsible for the mode or success of communication or delivery.

4. Shejar’s Limited Role and Disclaimer of Responsibility

Shejar operates purely as a digital facilitator that connects individuals who wish to give or receive items for free. We do not vet, monitor, endorse, or verify any of the following:

  • The identity or authenticity of any user.
  • The ownership, condition, functionality, or legality of listed items.
  • The accuracy or truthfulness of product descriptions.
  • The behavior or intentions of users during or after any exchange.

Shejar shall not be held liable for any damages, losses, misunderstandings, injuries, disputes, or liabilities arising from your use of the app or interactions with other users. By using the app, you understand and accept full responsibility for any and all risks involved.

Shejar does not facilitate, offer, or assume responsibility for logistics, delivery, packaging, product removal, or pickups of any kind.

5. User Obligations and Conduct

As a user of Shejar, you agree to:

  • Only list items that are legal and safe to give away.
  • Avoid uploading offensive, fraudulent, or misleading content.
  • Not impersonate others or misrepresent your identity.
  • Avoid using the platform for unlawful, harmful, or commercial purposes.
  • Respect the community guidelines and other users.

Shejar reserves the right to remove any content or suspend access to users who violate these terms or whose conduct may harm the integrity of the platform.

6. Ownership and Intellectual Property

All content, trademarks, designs, logos, text, layout, and functionality provided through the Shejar platform are owned by the company or its licensors. You may not use, copy, distribute, or modify any portion of the app without express written permission.

7. Termination and Suspension

We reserve the right to terminate or suspend your access to the platform, with or without notice, if we believe you have violated these Terms or engaged in behavior that compromises the safety or experience of other users.

8. Modifications to the Service and Terms

We may update or modify the platform, its features, or these Terms at any time without prior notice. Continued use of the app after such changes constitutes your acceptance of the revised Terms.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Maharashtra, India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune.
